Pune pregnant woman death case: Court awards 10-years sentence to two doctors for medical negligence and causing death

Pune: Court of Additional District and Session Judge Vikram Jagdale has awarded 10-years of life imprisonment to two doctors. They have been convicted of medical negligence and causing death of a pregnant 21-year-old woman while operating on her. The court has also praised the efforts of public prosecutor Rajesh Kawedia in securing conviction of the accused.

The convicted doctors are Dr Jitendra Shimpi (40) and Dr Sachin Hari Deshpande (39). The Pune court has also imposed a fine of Rs 2.5 lakh on the two. Anesthetist Dr Vijay Agarwal has been acquitted by the court in this matter. Dr Shimpi and Deshpande were convicted of causing death of one Rajashri Anil Jagtap (21). Rajashri’s husband Anil had filed a case in this regard at the Dehu Road police station in 2012.

The case

According to the complaint filed, Dr Shimpi used to run his hospital in Dehu Road area. Dr Deshpande used to work with him at the hospital. They both had completed their MBBS degree education. They were not authorised to undertake a cesarean operation as they were not educationally qualified for it.

Anil Jagtap is an ambulance driver. He and Rajashri had a daughter and at that time Rajashri had undergone cesarean operation at another hospital. When Rajashri conceived for the second time, she went at Dr Shimpi where he told her to get cesarean operation done. Dr Shimpi later planned the date for operation  Rajashri got admitted for operation, but due to medical negligence she started bleeding profusely. She was taken to another hospital but she succumbed to heavy bleeding on her way.

In the judgment, court has observed that Dr Shimpi and Dr Deshpande, even though being non-qualified for operating on a pregnant woman, carried out the operation and thus were responsible for her death. Court has praised the efforts of Public Prosecutor Rajesh Kawedia for presenting strong arguments, evidences and thus securing conviction of the accused.
