Pune: Special Judge Jayant Raje has refused to grant permission to Abu Dhabi based company AFCO Investment and Management to develop the DSK Dream City Project. The company had filed an application in the court in October and expressed its interest in developing the derailed project of builder Deepak Sakharam alias D S Kulkarni if the court grants permission.

The Special Court has refused permission to the company on the grounds that such permission cannot be granted at this stage of the ongoing hearing of the case. The company had filed the application through Advocate Chandrakant Bidkar.

The company, in its application, had stated that if its proposal is accepted then the company is ready to pay the advance amount. DSK had accepted the company’s proposal on the conditions that the construction would be done according to the original project plan approved (DPR) and affordable homes should be built.

The Special Public Prosecutor (SPP) had opposed the company’s application in the case. The SPP had argued that this case is not of settlement in nature and the applicants are wasting the precious time of court by filing such applications. Hence the application should be rejected, the SPP had requested.

The Special Court in its order has said that the government has initiated the process of taking over the property. “Since this process began, several applications objecting to it have been filed in the court. It seems that many of them have interest in the property. However, those objecting the process have not been able to furnish any evidence related to it. The recovery process will be initiated after the property is taken over. Hence the application filed cannot be considered at this stage,” the order states.
