Hathras Incident : Mention Of ‘Complete Penetration’ In Aligarh Hospital’s MLC, Dismissed In Final Opinion

Lucknow : The victim of Hathras had stated in a video in the injured condition that she was sexually assaulted, eight days later, in the victim’s medico-legal inspection by the hospital in Aligarh, ‘Complete penetration’ in the genitals, ‘strangulation’.

But Aligarh Muslim University’s (AMU) Jawaharlal Nehru Medical College (JNMC) in its final opinion, citing forensic analysis, ruled out the possibility of intercourse.

The Medico Legal Case (MLC) report of September 22 contradicted the UP police’s claims that no evidence of rape was found in the forensic investigation. Uttar Pradesh’s ADG (Law and Order) Prashant Kumar had insisted that no sperm / semen were found in the victim’s samples.

According to the preparations MLC by the forensic medicine department of JNMC, the victim had lost her mind at the time of the attack.

In conclusion, it was found that the victim was strangled with a scarf. Four suspects have been named on the basis of the victim’s statement. According to the MLC report, the victim’s mouth was ‘covered’ and she faced an attack with intent to kill.

In the diagrams associated with the findings, the ligature marks on the victim’s neck were 10×3 cm on the right side, and 5×2 cm on the left side of the neck.

But there is no report of injury in the diagram showing the vaginal area.

Complete penetration
However, the MLC has recorded that ‘complete penetration’ was done.

Signed on behalf of Dr. Faiz Ahmed, Assistant Professor in the Forensic Medicine Department of JNMC, the report reads “no address” in a section. This section was in relation to whether there were samples of semen inside or outside the victim’s body parts or clothes.

The inspection report was completed on September 22 at 1.30 pm. The victim was attacked on 14 September. According to the inspecting doctor role, the victim was forced. However, she also said that a detailed opinion can only be given by a competent Forensic Science Laboratory after a detailed analysis.

Dr. Bhumika wrote, “Based on local inspection, I am of the opinion that there are indications of the use of force. However, opinion regarding penetrative intercourse is safe as availability of FSL report is pending.”

But in a letter to Sadabad police station in Hathras district on 10 October, the JNMC cited a full forensic investigation of the samples and concluded that the victim was not sexually assaulted. It states that ‘there are no signs of vaginal / anal intercourse.’

The letter signed by Dr. Ahmed mentions the injury marks on the neck and back of the victim. JNMC’s Department of Forensic Medicine said “there is evidence of physical assault (neck and back injury)”.

Earlier, BJP’s IT cell downplayed the allegations of rape in the case by citing videos of the victim and her mother.

But the same statement of the victim and her two other videos were heard with caution when it came to light that the victim had complained of sexual harassment by the attackers.
